In a recent court findings, Branco v. American Home Assurance Company, the court found that the insurer's denial of disability benefits was determined to be bad faith on the insurer's part. This then resulted in a record $4.5 million dollar finding in favour of the plaintiff.
The problem for both the injured person and the insurer is how to determine if an injury is or is not due to a motor vehicle accident. Pain research has shown that 90% of pain is generally inhibited as a survival mechanisim and thus an injury, instability or tissue damage could be present and unrecongized prior to a collision.
The answer is through crash forensics. This service evaluates the occupant kinematics that would have occured in a collision based on collision variables, risk factors and the occupant in order to determine which structures could be injured based on the crash forensics research.
By using crash forensics, we can then determine if a physical limitation or impairments is directly realted to the motor vehicle accident or not. This will allow for an accurate, defenisble and scientifcally sound determination of need.
